“Service” refers to the “BRDGE Business Networking Service” in all its available forms particularly as website or as app.
“App” refers to each application, provided by us for the use of our service, for mobile data end devices irrespective of the operating system.
“Website” refers to our website on www.brdgeapp.com.
“User” refers to all users of our service.
“Data” refers to individual details which are in association with you and your use of our service but which do not enable anyone to draw any conclusions concerning you personally for example (but not conclusively) the type and model of your end device which you used to use our service, its operating system, language and screen resolution.
“Information” refers to individual details which individualise you as person or which (also indirectly) enable conclusions to be made concerning you personally and/or could lead to your individualisation. This includes data concerning you personally and circumstances (person related data in the sense of the Federal Data Protection Act) for example (but not conclusively) your name, e-mail address, age, place of residence or your current location, your photo, your education/schooling, your profession, your employer and your work status.
1.7 Collection of information and data
“Collection” refers to the obtaining of information and data. We collect information and data either through the provision of this information and data by you or by requesting or reading this information and data from the end device which you use when using our service.
1.8 Processing of data and information
“Processing” of information and data refers to the storing, modification, sharing, blocking and/or deleting of information and data and includes the use of information and data.
1.9 Sharing information and data
“Sharing” information and data means that we forward this information and data to third parties and make this accessible to third parties. Hereby the enabling of accessibility may occur towards the public, all or only individual users (e.g. direct conversation or chat partners) or third parties we use in association with the offer, provision, supply and realisation of our service and/or its further development (see also Figure 6).
2. Information and data we collect about you
2.2 Information which we receive from you
If you would like to use our service you are requested to register using your LinkedIn log in. By registering for the use of our service with your LinkedIn log in, you are allowing us to access information which you have stored in your profile and collect, process and share this information for the further use of our service. The information which we use from your LinkedIn profile includes particularly although not conclusively: your name, photo, age, your current employer as well as your current position as stated in LinkedIn as well as your endorsements. You are also requested to allow us to collect, process and share your current location from where you are using our service via your (mobile) end device. Furthermore, we also receive all the information and data which you enter, up or download or provide in any other way on the website and/or the app when using our service, and we may collect, process and share this data in association with the provision and optimisation of our service. This information also includes the information and data stored on your mobile end device (including information and data about the mobile end device used) if, during the installation of the app, you have given us permission to use and collect this information and data. If you use the messenger function integrated in our service, particularly if you chat with other users or communicate with other users of our service in any other way via the website or the app, we receive the content of this chat / communication and may process and particularly analyse and evaluate this content to improve our service as well as control adherence to our “General terms and conditions of use” (INSERT LINK) and monitor the correct and legal use of our service. This communication content is only forwarded, subject to Figure 6, to the user (or in the case of group chat, the users) who you chatted with or communicated with in another way. If you contact us via the website, the app or in another way (e.g. by e-mail), we receive all information which you have provided us with in association with this (e.g. but not conclusively, your name, e-mail address, the message sent to us, any attachments including the information found herein, information on the end device used by you to send the message and the software required for this.)
2.3 Technologies for the collection of information
We use various technologies to collect information about you, your end device and your activities in association with the use of our service.
2.3.1 Automatic data collection
When you use our service we automatically collect information and data concerning your (mobile) end device with which you are using our service. This may include, in particular but not conclusively, the type, the device type and number of your end device, its operating system, language and screen resolution, your IP address, the browser type used (incl. version number and language), the access time, your current location whilst using our service as well as the address of the website from which you accessed or were forwarded to our service.
2.3.3 Other technologies
We may use standard internet technology (e.g. web beacons and similar technologies) to analyse your use of our service and/or communicate with cookies. Web beacons and similar technologies may also be included in messages and e-mails which you receive from us to check whether you have opened our messages. The insights gained in this way help us measure the appeal of our service, adapt our service to suit the needs of our users better and continuously improve this.
3. How we process your information and data
We may process your information and data particularly, although not solely, for the following reasons:
3.1.1 To offer, provide and realise our service.
3.1.2 To manage your customer account and give you support regarding this and in association with your use of our service.
3.1.3 To analyse your use of our service and your interests to measure the appeal of our service and to offer you and other users new or other services based on the results of this analysis and/or adapt our service to suit the needs of our users better and optimise this further.
3.1.4 To communicate with you (particularly by e-mail) and present new or other services to you which we think may be of interest to you.
3.1.5 To control adherence to our General terms and conditions of use, to monitor the correct and legal use of our service and assert our rights and legitimate interests. We may carry out these and comparable measures ourselves or request third parties, particularly technical partners (see Figure 6), to do so.
3.2 Who we share your information and data with
3.2.1 With users
When you register to use our service, your BRDGE profile is visible to all users of our service. The users of our service are then able to see all the information and data which we have received from you via your LinkedIn profile or which you have entered for publication in your BRDGE profile on the website / app. If you allow a user to contact you, who has also given permission for you to contact him, this user may chat with you or send you messages in another way. If you chat with one or more users or interact in another way, particularly through the exchange of messages, the other user(s) can see the messages which you sent him/them.
3.2.2 With technical partners
We are entitled to share your information and data with technical partners in association with the offer, provision, supply and realisation of our service. Further information on this in Figure 6.
3.2.3 With third parties
(a) Law enforcement
If we are asked by the law enforcement authorities (incl. the police), courts or another state or federal authority for information, we are obliged to fulfil our legal obligations and share your information and data with these authorities or courts.
(b) Risk prevention and avoidance
If we have justified reason to assume that, through the use of our service, an illegal act is planned/is taking place or has already occurred or that the interests (particularly the property and safety) of our company, our employees or the users of our service are (might be) at risk, we are entitled to take appropriate and effective measures for risk prevention and avoidance within the legally permitted frame. In this context we may share your information and data with the law enforcement authorities (incl. the police), the courts, state or federal authorities and legal advisors.
(c) Prosecution and legal defence
In all cases in which it is deemed necessary and appropriate we may share your information and data with the law enforcement authorities (incl. the police), courts, state and federal authorities and legal advisors to pursue our own legal claims, defend ourselves in the case of claims against us, assert our legitimate interests, control adherence to our General terms and conditions of use or ensure the legal and correct use of our service.
(d) Presentation of the company and investors
We may share your information and data – after we have anonymised this so that you cannot be individualised or that any conclusions may be made concerning you personally – with third parties (in particular with the general public, representatives of the press as well as financial institutions and investors) to present our company, our service and its acceptancy, reach and user structure; to conduct general business analyses as well as company transactions (e.g. sale of our company or our service or the fusion of our company with another company) or to prepare or implement the consolidation, reorganisation or restructuring of our company or service.
(e) Legally stipulated cases
In all cases in which we are legally obliged, we may share your information and data with those third parties who are legally entitled to this.
4. How you can block certain information and data
4.1.1 Data collection through us
The collection of certain information and data (for example your current location) requires your permission for the release of such details. You can prevent the collection of this information and data through us by refusing to grant the required permission. You can prevent the installation of and communication with cookies through your browser and set this to prevent the installation of the cookies or to delete the cookies which have been installed or delete the cache on your mobile end device. You can find further information on this from the usage instructions or help function of your browser or mobile end device. Please note that if you refuse certain information or the cookies or delete these, it may prevent or limit the functioning of our service.
4.1.2 Contact by other users
A user may only contact you, particularly to send you messages, if you have given your permission for this. If you do not want to receive a message from a particular user you can refuse the contact request.
5. Information which you voluntarily provide when using our service
Our service offers you the possibility to provide information and data about yourself and communicate and interact with other users of our service. The information and data which you voluntarily provide as well as the communication with other users are subject to the requirements and limitations of our General terms and conditions of use. Please always consider that all information and data which you voluntarily provide – also in the communication and interaction with other users of our service – may be seen, collected and used by other users and third parties. Please also consider that we have no possibility to control, monitor or influence how other users or third parties use this information and data which you have voluntarily provided. Although we will always respond to any specific cases of misuse of information and data of our users which become known to us, we expressly recommend, in your own interests, that you are careful with view to which data and information you provide when using our service.
6. Data exchange with technical partners
In association with the offer, provision, supply and realisation of our service we use the services of third parties (“Technical partners”). These technical partners provide, for example although not conclusively, services which are essential for the messenger function which is provided within the frame of our service. Several of these technical partners are not located in the area of the European Union but in the United States of America and are not, therefore, subject to the data protection regulations of the Federal Republic of Germany or the European Union. Through the use of our service – irrespective in which way or with which end device – you allow us, in association with the offer, provision, supply and realisation of our service, to share your information and data with our technical partners and process this information and data on data processing equipment in Germany and abroad (also outside the area of the European Union).
7. Protection of children and young people
The use of our service is only permitted for people of full/legal age and who are legally competent in accordance with the law of the country in which they have their place of residence or in which they are using our service. With the use of our service you confirm that you have fulfilled both these requirements and are not legally deemed a child or young person particularly in accordance with the law of the country in which you have your place of residence or in which you are using our service.
